Terms of Service

1. Agreement and the service

These Terms of Service (“Terms”) are an agreement between you and IhsanWorks LLC (“IhsanWorks,” “we,” “us,” or “our”) for your use of Debt to the Divine (“Service”), including its website and mobile application. By accessing or using the Service, you acknowledge that you have read these Terms and agree to them. If you do not agree, do not use the Service.

The Service is a personal worship-tracking tool. It lets you record missed prayers and fasting days, set a target date, calculate a suggested daily goal, and record progress. Available features may differ between the web and mobile versions.

2. Eligibility and parental responsibility

You may use the Service only if you can legally enter into a binding agreement where you live. The Service does not impose a specific minimum age in these Terms. If you are a minor, your parent or legal guardian must review these Terms, give permission for your use where required, and accept responsibility for your use and any purchases. Do not use the Service if applicable law prohibits you from doing so.

3. Guest and account use

You may use the Service as a guest without creating an account. Guest profiles and progress are kept in local browser or device storage; they are not sent to our servers unless you choose to create or use an account and complete the available transfer. Clearing storage, browser data, or uninstalling the mobile app may permanently remove guest data. Guest data is not synchronized across devices.

An account can allow worship records and profile information to be stored and synchronized through the Service. You are responsible for providing accurate information, protecting access to your account, and promptly telling us if you believe it has been used without permission. We are not responsible for loss caused by credentials or access you fail to protect.

4. Reminders, records, and religious guidance

If you enable notifications or reminders, the Service may send reminders using the permissions and settings on your browser or device. Reminders can be delayed, missed, disabled, or unavailable. Do not rely on them as your only way to remember an act of worship.

You are responsible for the accuracy and completeness of the counts, dates, preferences, and progress you enter. Calculations and goals are organizational aids, not guarantees that your records are complete or correct.

The Service is not religious advice, a fatwa, or a substitute for a qualified scholar or trusted religious authority. Views about missed prayers, fasting, Witr, madhhab practices, and female-specific adjustments can differ. We do not determine what you owe or what is religiously required for you. Seek advice from a qualified person for your circumstances. The Service is also not medical, financial, tax, or legal advice.

5. Acceptable use

You agree not to:

• break applicable law or violate another person’s rights;
• impersonate another person or misuse another person’s account;
• interfere with, probe, overload, or attempt to gain unauthorized access to the Service;
• introduce malware, scrape the Service, or use it to build a competing service; or
• submit content that is unlawful, fraudulent, abusive, or infringing.

You are responsible for content and information you submit, including profile notes and feedback. Do not submit information about another person unless you have the right to do so.

6. Your content and feedback

You retain your rights in worship records, profile information, notes, and other content you submit. You grant IhsanWorks a limited, non-exclusive permission to host, store, process, and display that content only as reasonably needed to operate, secure, support, and improve the Service. Your submitted content is not made public by these Terms.

If you send a suggestion, idea, or other feedback, you allow IhsanWorks to use it without restriction or compensation. This does not give us ownership of your private worship records or personal notes.

7. IhsanWorks property

The Service, including its software, design, text, graphics, logos, and other materials created by or for IhsanWorks, belongs to IhsanWorks or its licensors and is protected by applicable law. Subject to these Terms, we give you a limited, personal, non-transferable, non-exclusive license to use the Service for its intended purpose. No other rights are granted, and you may not copy, modify, distribute, sell, or reverse engineer the Service except as permitted by law.

8. Contributions and Monthly Support

You may voluntarily make a one-time contribution on the website through Stripe. The website may also offer a recurring contribution through Stripe Checkout. These are separate from the mobile purchase described below and do not create an Apple subscription. Stripe processes the payment; we do not receive or store your full card number.

The mobile app may offer “Monthly Support,” an auto-renewable monthly in-app purchase. Apple/App Store processes the purchase and charges your Apple ID at the localized price shown before purchase. Apple controls App Store billing and refunds. RevenueCat supports the in-app purchase infrastructure and entitlement status on our behalf. Apple’s terms and account settings also apply. You may use the app’s restore-purchases option for an eligible purchase associated with your Apple account.

Contributions and Monthly Support are voluntary support for the project, not payment for religious guidance. Nothing in these Terms represents that a contribution is tax-deductible, that a particular refund is available, or that any contribution will be used for a particular purpose.

9. Privacy and third-party services

Our Privacy Policy is incorporated into these Terms by reference. It describes the account information, worship and progress data, profile preferences, payment records, feedback, and basic logs we handle, along with local guest storage and deletion choices. It also describes our use of Clerk, Replit-hosted storage, Stripe, Apple, and RevenueCat.

Those providers operate their own services and may have separate terms and privacy policies. We are not responsible for third-party services, their availability, or their acts and omissions. Your use of the mobile app is also subject to the Apple Media Services Terms and other applicable platform rules.

10. Availability and changes

We may maintain, update, suspend, limit, change, or discontinue all or part of the Service, including features and reminders, at any time. The Service may be unavailable or inaccurate because of maintenance, connectivity, device settings, provider outages, or events outside our control. Keep your own records if they are important to you.

We may update these Terms by posting a revised version with a new date. Your continued use after an update means you accept the revised Terms to the extent permitted by law. If a change requires additional notice or consent, we will provide what applicable law requires.

11. Suspension and termination

You may stop using the Service at any time and may delete your account using the available Settings controls. We may suspend or terminate access, or remove content, if we reasonably believe you violated these Terms, created risk, or used the Service unlawfully, or when needed to protect the Service or other users. We may also discontinue the Service.

When access ends, your license to use the Service ends. Sections concerning ownership, feedback, disclaimers, limits of liability, indemnity, disputes, and other provisions that by their nature should continue will survive. Account deletion or app deletion does not itself cancel an Apple subscription; Apple manages that subscription separately.

12. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” IhsanWorks DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, AND STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AND AVAILABILITY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT DATA OR CALCULATIONS WILL BE PRESERVED. THESE DISCLAIMERS DO NOT LIMIT RIGHTS THAT CANNOT LAWFULLY BE LIMITED.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IhsanWorks AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, GOODWILL, OR BUSINESS, ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICE IN THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

14. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless IhsanWorks and its owners, officers, employees, contractors, and licensors from claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the Service, your violation of these Terms, or your content. This provision does not require you to indemnify a party for that party’s own unlawful conduct.

15. Governing law and disputes

These Terms and your use of the Service are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Any dispute arising from or relating to the Service or these Terms must be brought exclusively in the state or federal courts located in New Castle County, Delaware, and you and IhsanWorks consent to the personal jurisdiction of those courts.

These Terms do not require arbitration, waive a jury trial, or restrict participation in a class action. Nothing in this section limits rights that cannot lawfully be limited.

16. General terms

These Terms, together with the Privacy Policy and any terms clearly presented for a specific feature or purchase, are the entire agreement about the Service. If a provision is unenforceable, it will be modified or severed only to the extent necessary and the remaining provisions will remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign them in connection with a merger, reorganization, sale, or transfer of the Service.

Nothing in these Terms creates a partnership, agency, employment, or fiduciary relationship between you and IhsanWorks. Headings are for convenience only.
